Risks of negotiation mode in tenders for skatepark construction

The selection of a contractor for a skatepark is a decision that directly affects the quality, safety and durability of the facility. Unfortunately, more and more often we encounter a situation in which ordering parties decide to organize a tender in the so-called "negotiated mode". Although in theory it is supposed to allow for better tailoring of the offer to the needs, in practice it carries many risks - both for investors and for skatepark users themselves.

In practice, the mode with negotiation does not lead to a real dialogue about the quality of solutions or conditions of implementation. "Negotiation" amounts to opening bids and allowing a second round of proposals. This means that contractors know the prices of the competition and the contracting authority's budget, which turns into a purely price race. Companies that have priced the investment fairly from the beginning face pressure to drastically reduce their bids, which is most often not feasible, assuming that the quality of the final facility's workmanship is maintained.

The strategy of "first inflate, then lower"

The negotiation mode also gives a gateway to manipulate the valuation of the implementation. Unscrupulous contractors take advantage of this system, deliberately inflating their first bids in order to lower the price in the second stage and allow the ordering parties to linger in the belief that they have "negotiated" more favorable terms. This is only an apparent success - in practice, it is a slick trap that discredits companies that have played open cards from the beginning.

The consequences: lower quality and less security

The most serious problem, however, is that downward pressure on price directly leads to cuts in material and labor costs. In the case of skateparks, this means weaker structures, inferior surfaces or limited supervision, among other things. This is a real threat to the safety of children and young people who will use these facilities. Unfortunately, most ordering parties are not aware of this, as this is usually the first Skatepark they are dealing with.

What does the ordering party gain and what does it lose?

The basic mode with negotiation rarely gives real added value. Instead of a conversation about innovation, there is a price race. Instead of partnership, we have the fiction of negotiation. As a result, the ordering party often receives an inferior facility, and an investment that was supposed to serve the local community for years, very quickly requires repairs and upgrades.
